PHILIPPE RENIER
 
Philippe Renier - a graduate from the University of Antwerp (2001) - has more than 17 years of experience in Tax law in various top tier law firms.

Philippe has extensive experience in assisting national and multinational industrial and financial companies with complex tax controversy issues.

He has an excellent reputation and good contacts with the tax authorities. Philippe has significant experience undertaking remedial action after an audit by the special tax inspectors' team, as well as tax settlement procedures before tax authorities and the public prosecutor, where he uses mediation and negotiation techniques.

As a tax litigator, Philippe has in-depth experience of complex tax litigation procedures before all Belgian and European Courts, especially regarding tax fraud, withholding tax claims, transfer pricing, permanent establishment issues and anti-avoidance rules.

Philippe has experience assisting multinational industrial and financial clients (banks) for EEC Arbitration Convention procedures, as well as on claims and ruling requests (involving domestic and EU law, application of tax treaties, anti-avoidance rules, non-discrimination principle).

Philippe litigated/is litigating the following milestone cases before the European Court of Justice:

C-499/07 - excess dividend received deduction

C-68/15 - fairness tax & tax on dividends

He also successfully defended cases before the Belgian Constitutional Court (eg. article 356 BITC92, Fairness Tax, etc.), he is the main driver behind the Corsan group litigation, was lead lawyer in a major corporate tax dispute re. article 207 BITC92 and a tax dispute of a Belgian payment service provider (provider who rightfully refused to cooperate with a request for information of the STI to exchange all transactions processed with foreign payment cards). Philippe defends multiple SME's in their disputes with the tax authorities.

Philippe is a Professor at the Brussels University (ODISEE) where he lectures 'Tax procedural law'. He is linked to the University of Hasselt as a voluntary researcher in the area of tax law.

Philippe has published numerous tax-related articles in matters that concern national and international tax litigation. He regularly lectures on specialised tax conferences and is regularly quoted in the press.

He is a Dutch native speaker, fluent in French and English and proficient in Spanish.
